These Terms do not replace separate written contracts, master service agreements, work orders, employment agreements, offer letters, independent contractor agreements, or client service agreements. If a separate signed agreement conflicts with these Terms, the signed agreement controls to the extent of that conflict.

Eligibility

You may use our website and services only if you can form a binding agreement under applicable law.

The Employee SMS Program is available only to:

existing Manzanita Security employees;
whose mobile numbers are on the authorized employee list; and
who complete the required SMS consent flow.

Unauthorized access to employee-only systems or messaging features is prohibited.

Services

Manzanita Security provides private security and related operational services, along with internal workforce communications tools and website content.

We may update, modify, suspend, or discontinue any part of our website, internal systems, or communications at any time, with or without notice, to the extent permitted by law.

Website Use

You agree to use the website only for lawful purposes.

You may not:

use the website in violation of any law or regulation;
attempt to gain unauthorized access to accounts, systems, or data;
interfere with the operation or security of the website;
upload malicious code, bots, scrapers, or harmful content;
impersonate another person or entity;
misuse contact forms, support channels, or messaging systems;
copy, reproduce, or exploit website content except as permitted by law or with our written permission.

We may monitor, investigate, block, suspend, or report misuse.

Employee SMS Program Terms

Program description

Manzanita Security operates an employee-only operational SMS program used for:

shift reminders and clock actions;
supervisor callback requests;
one-time lock access code requests; and
employee enrollment and consent verification.

This program is not offered to the general public.

Enrollment

Only employees whose numbers are on Manzanita Security’s authorized employee list may enroll.

To enroll, an eligible employee must receive the consent request message and reply YES. Enrollment is not complete until that consent step is completed.

If a number is not authorized, enrollment may be denied.

Message frequency

Message frequency varies based on work activity, including assigned shifts, support requests, lock access requests, and related operational needs.

Message and data rates

Message and data rates may apply according to the employee’s wireless carrier plan.

HELP and STOP

Employees may reply:

HELP for assistance
STOP to opt out

Opting out will stop future operational SMS messages unless and until the employee validly re-enrolls.

Supported commands

Depending on workflow and eligibility, the system may support commands such as:

STOP
START SHIFT
CLOCK OUT
REQUEST CALL
UNLOCK {lock_id}

We may add, remove, or modify supported commands at any time.

Program limitations

We do not guarantee that SMS messages will be delivered, received, or processed in real time. Delivery may be delayed or prevented by carriers, device settings, coverage, outages, filtering, technical failures, or other factors outside our control.

Employees remain responsible for complying with job duties, reporting obligations, attendance requirements, and supervisor instructions even if a message is delayed or not received.

Consent to communications

By opting in, you consent to receive operational text messages from Manzanita Security at the mobile number you provided or that is associated with your authorized employee record, subject to these Terms and our Privacy Policy.

Internal Tools and Access Controls

If we provide portals, dashboards, or internal applications:

access is limited to authorized users;
credentials must be kept confidential;
you are responsible for activity under your account;
you must notify us promptly of suspected unauthorized access;
we may revoke access at any time for security, operational, legal, or policy reasons.

No Emergency Reliance

Our website and SMS program are not guaranteed emergency-response systems.

Do not rely exclusively on the website or SMS for urgent emergencies, life-safety events, or situations requiring immediate law enforcement, fire, or medical response. In an emergency, call 911 or the appropriate emergency service.

Accuracy of Information

You agree to provide accurate, current, and complete information when communicating with us or using our systems.

You are responsible for promptly updating relevant contact information, including mobile number changes where applicable.

We may rely on the information provided to us unless and until it is updated.

Client and Employment Matters

Nothing in these Terms:

guarantees employment, continued employment, assignment, or scheduling;
alters at-will employment status unless otherwise stated in a signed writing;
guarantees any minimum level of work, assignment, or compensation;
creates a client-services commitment beyond a signed services agreement.

Operational messages are provided as an administrative convenience and do not replace official employment, payroll, disciplinary, client, or contract records.

Intellectual Property

All content on our website and in our systems, including text, branding, logos, graphics, layouts, software, workflows, and documentation, is owned by or licensed to Manzanita Security and protected by applicable intellectual property laws.

Except as expressly permitted, you may not use, reproduce, distribute, modify, display, or create derivative works from our content without our prior written consent.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms will not exceed the greater of:

one hundred U.S. dollars ($100), or
the amount you paid directly to us, if any, for the specific service giving rise to the claim in the 12 months before the event giving rise to liability.

Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.

You agree to defend, indemnify, and hold harmless Manzanita Security and its officers, directors, employees, agents, affiliates, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising from:

employment termination or change in authorization status.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except where federal law applies.

Venue

To the extent permitted by law, any dispute arising out of or relating to these Terms will be brought exclusively in the state or federal courts located in or serving Marin County, California, and each party consents to that venue and jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised version and update the “Last Updated” date.

Your continued use of the website, services, or messaging program after updated Terms are posted constitutes acceptance of the updated Terms, to the extent permitted by law.
